Faegre Baker Daniels Achieves Jury Verdict in Favor of Zimmer Inc.

n July 11, 2019, a Florida jury found in favor of Zimmer Inc. and its allegedly defective Kinectiv dual modular hip implant in a lawsuit alleging that it sold a defective prosthetic hip implant device and neglected to warn doctors about risks associated with metal corrosion that left a Florida woman, Diane Noto, injured.

Noto claimed in the suit, filed in Tampa in 2017, that Zimmer neglected to warn orthopedic surgeons about the potential risks with the M/L Taper Hip Prosthesis with Kinectiv Technology, such as corrosion, metal wear debris and other byproduct releases that cause cell injury and other swelling and adverse tissue reactions. After less than an hour of deliberation, the jury found that Zimmer’s Kinectiv dual modular hip device was not defective and did not cause Noto’s injuries.
