The Tenth Circuit on Tuesday refused to resuscitate a disability bias suit by the U.S. Equal Employment Opportunity Commission accusing BNSF Railway Co. of illegally pulling a job offer to a prospective electrician because the company believed him to be disabled due to a limited ability to perform certain functions with his right hand.
