Capone v. Philip Morris

On December 17, 2018, after a two-week trial, a jury in Miami delivered a favorable verdict for Venable’s client Philip Morris in a rare, non-Engle progeny lawsuit brought on behalf of a Florida man who died of lung cancer after smoking for nearly 40 years.

Jessica Grant (Picture) served as lead trial counsel. His widow and daughter sued Philip Morris alleging causes of action for strict products liability, negligence, fraud and conspiracy.

The jury found that the decedent was 90% responsible for his lung cancer and death and awarded damages totaling $225,000.
